In April 2004, the FHWA issued a finding of no significant impact
(FONSI) for the 10400 South, Bangerter Highway to Redwood Road
Project. Final design for this project is near completion. On September 13, 2005, the FHWA issued a record of decision (ROD) for
the 11400 South EIS, selecting EIS Alternative 4 as the best solution to
the existing and projected transportation needs in the Study Area.
Design and construction for these projects is on hold. They are
currently being challenged in federal district court. Plaintiffs assert
that the Environmental Studies which were prepared under the National
Environmental Policy Act (NEPA), and the avoidance and alternatives
evaluation under Section 4(f) of the Transportation Act, were
inadequate.
A federal district court hearing on the merits of the case was held on March 20 and 21,
2007 in Salt Lake City. We are awaiting a decision from Judge Bruce Jenkins to be issued.
Depending on the decision, we could either proceed with final design and construction of the
10400 South Project, or continue with further litigation, or even a combination of the two.

At the most recent Design Committee Meeting in August 2005, the committee discussed holding another meeting early in 2006
to discuss construction issues such as phasing, property access during construction, and limitation of construction
operations. This meeting has been postponed indefinitely. A complaint for declaratory and injunctive relief was recently
filed in U.S. District Court regarding the 10400 South widening project between Redwood Road and Bangerter Highway.
At this time, UDOT plans to continue right-of-way acquisition and the design of 10400 South, but will not be advertising
this project for construction as previously scheduled.
Team members will continue to meet with individual property owners throughout the spring of 2006 to discuss design and
right-of-way details, but no further Design Committee Meetings are planned at this time. If you would like to discuss

Project Overview: In April 2004, the Utah
Department of Transportation received a Finding of
No Significant Impact (FONSI) from the Federal Highway Administration
for the 10400 South Environmental Assessment. UDOT has now moved into
the design phase on the 10400 South corridor between
Bangerter Highway and Redwood Road. The proposed
improvements that will increase safety and reduce congestion
include the following:
· Widening and reconstructing the roadway to a
cross section of two lanes in each direction with a center
turn lane and medians.
· 10 foot shoulders to accommodate designated one-
way bike lanes and bus service on each side of the road
· Curb, gutter, park strips and 6 foot sidewalks
on both sides of the roadway
· Signal and intersection improvements at 2200 West, 2700 West, and 3200 West
· Street lighting to increase visibility and improve
pedestrian and auto safety
