Environmental Commitments

UDOT Legacy

Wetland Preservation

  • The 404 Permit allows the Legacy Parkway to impact 103 acres within the right of way. UDOT will impact no more than that.
  • Through ongoing design efforts UDOT is committed to reducing the number of wetlands impacted. At present, that number has been reduced to fewer than 100 acres.
  • UDOT will use silt fence to protect wetland areas outside the right of way. The silt fence helps to limit the amount of silt and sediment that is redistributed outside the right of way through the process of erosion.

Threatened and Endangered Species

Within the boundaries of the Legacy Nature Preserve is a productive bald eagle nest and a number of snags frequently used by roosting bald eagles. To protect these eagles and their young UDOT's commitments include:

  • Maintaining a one-mile buffer zone from the eagle nest in the Legacy Nature Preserve (LNP)
  • Maintaining a one-half-mile buffer zone from the eagle roost in the LNP (near 500 South)
  • Restricting construction activities in the area frequented by eagles during sensitive times (including the nesting season)
  • Conducting a nest survey of raptors (including the bald eagles) prior to the start of construction and each year subsequently
  • Maintaining close communication with the Fish and Wildlife Service to determine when and if additional restrictions are necessary

Water Quality

The construction contractor will maintain:

  • A permit from Utah Pollution Discharge Elimination System (UPDES)
  • A Storm Water Pollution Prevention Plan (SWPPP) requiring silt fences in an effort to control silt and sediment from getting into the water
  • A De-Watering Permit requiring that water quality be maintained at certain levels
  • A Stream Alteration Permit any time the contractor must cross a stream

Design commitments include:

  • Vegetation filters for run-off from roads
  • Sheet flow to spread out run-off and reduce erosion
  • Retention and detention ponds as needed

Other Commitments

  • Qualified archeologists will monitor all excavation activities to look for historical artifacts and items of cultural significance.
  • UDOT will monitor air quality during construction and will water work and traffic areas in a concerted effort to minimize dust impacts on local communities.
  • Full-time environmental monitors will oversee Legacy Parkway construction to ensure full compliance to UDOT's environmental commitments.
