Environmental Categorical Exclusion (CE) Delegation Information
The FHWA and the UDOT have a MOU under which the FHWA assigns to the State the FHWA's responsibility for determining whether a project is categorically excluded from preparation of an environmental assessment or an environmental impact statement. The MOU also assigns the State responsibility for conducting environmental reviews, consultations, and related activities for Federal-aid highway projects.

On July 1, 2008, UDOT and FHWA signed a Memorandum of Understanding (MOU) regarding the State Assumption of Responsibility for Categorical Exclusions (CE). Any CE documents that were not signed and approved prior to July 1, 2008, need to be reclassified to reflect the classification system detailed in the MOU.
