Encroachment Permit
Utah Code Section 72-7-102 prohibits digging or excavating within the state right-of-way to place, construct, or maintain any approach road, driveway, pole, pipeline, conduit, sewer, ditch, culvert, billboard advertising sign, or any other structure or object of any kind or character without first obtaining a permit.
An encroachment permit allows certain time-limited construction, installation, and repair-related activities to take place within the state right-of-way in conformity with state and federal law.
Before an encroachment permit is issued the applicant must complete a number of procedural requirements including, but not limited to:
Statewide Utility License AgreementAll Utilities located within State Highway Right of Way must enter into a license agreement with UDOT. Link for more information on Statewide Utility License Agreements
Performance & Warranty Bond A Performance & Warranty Bond is required for all encroachment permits. Applicants have the option to secure an Individual or Statewide bond depending on their business need and the frequency in which they apply for an encroachment permit. The minimum coverage amounts are $10,000 for the Individual bond and $100,000 for the Statewide bond. Both bonds must cover a three (3) year term and must be submitted using the approved UDOT bond forms (listed below under Downloads).
Inspection BondUDOT may require an additional inspection bond to ensure payment for UDOT field review and inspection costs before an encroachment permit is granted.
Minimum Liability Insurance CoverageApplicants are also required to provide a certificate of liability insurance in the minimum amounts of $1,000,000 per occurrence and $2,000,000 in aggregate.

IMPORTANT NOTE: This is the new Individual Performance & Warranty Bond Form as required under the revised Utility Accommodation Rule (R930-7). Older Region Performance & Warranty Bond Forms will no longer be accepted starting on November 19, 2012. The minimum individual bond amount is $10,000 with a minimum warranty term of three (3) years. Please contact the Region Permits Office with any questions.
IMPORTANT NOTE: This is the new Statewide Performance & Warranty Bond Form as required under the revised Utility Accommodation Rule (R930-7). Older Region Performance & Warranty Bond Forms will no longer be accepted starting on November 19, 2012. The minimum statewide bond amount is $100,000 with a minimum warranty term of three (3) years. This bond, unless otherwise stated as an additional permit condition, is valid for all encroachment permits throughout the state. It is a rolling three (3) year warranty term, which only requires an annual renewal. In other words, statewide bonds with less than two (2) full years of warranty protection will require renewal prior to permit issuance. Please contact the Region Permits Office with any questions.

IMPORTANT NOTE: The T-223 Form (Right-of-Way Encroachment Permit Application) is provided to the public as a manual application form, which is intended to be printed, completed, and submitted in-person to the appropriate Region Office for manual application processing.
The public is encouraged to complete this manual application process only as a last resort.
